These Terms of Service (“Terms”) govern your use of The Creator Estate (“TCE”, “we”, “us” or “our”) website, memberships, creator services, events, retreats, agency services and other products or services provided by us.

By purchasing, applying for, booking or using any TCE service, you agree to these Terms. Please read them carefully before making a purchase or joining The Creator Estate.

1. About The Creator Estate

The Creator Estate is a creator-focused business providing services which may include creator memberships, education, networking, brand introductions, talent and agency services, events, retreats, content opportunities and other experiences.

Certain services may be subject to additional agreements or booking terms. Where separate terms are provided for a particular service, those terms will also apply.

2. Applications & Acceptance

Certain areas of TCE are application-based.

Submitting an application does not guarantee acceptance. We reserve the right to accept or decline applications at our discretion where lawful.

We may consider factors including your personal brand, content quality, professionalism, experience, social media presence and overall alignment with The Creator Estate.

Applicants must provide accurate and truthful information.

3. Membership

TCE memberships may provide access to benefits including:

  • Creator education and resources
  • Networking opportunities
  • Community access
  • Brand and industry insights
  • Events and experiences
  • Priority access to selected opportunities
  • Creator support
  • Access to selected TCE services or benefits

The exact benefits included will depend on the membership or package purchased and will be described at the point of purchase.

Membership benefits may evolve as TCE develops. We may introduce, replace or update features provided that the overall nature of the service is not materially reduced without appropriate notice.

4. Onboarding & Joining Fees

Certain memberships or services may require a one-off onboarding, joining or setup fee.

Where applicable, the fee and everything included within the onboarding package will be clearly communicated before purchase.

Any cancellation or refund rights that apply by law are not affected by these Terms.

5. Monthly Membership Payments

Where you purchase a recurring membership, your selected payment method will be charged according to the billing frequency displayed at checkout.

Your membership will continue until cancelled in accordance with the cancellation terms applicable to your membership.

You are responsible for ensuring your payment details remain valid and up to date.

If a payment fails, access to membership benefits may be temporarily suspended while payment remains outstanding.

We may change membership pricing from time to time. Existing members will be given reasonable notice of changes affecting their recurring subscription where required.

6. Brand Collaborations & Opportunities

Membership of TCE does not guarantee brand collaborations, gifted opportunities, paid work, PR invitations, representation, income or any particular level of exposure.

Opportunities depend on factors outside TCE's control, including brand requirements, budgets, campaign objectives, location, audience, content style and creator suitability.

Our role is to provide services, connections, resources and opportunities where available. We cannot guarantee that every member will receive the same opportunities.

Where an opportunity is offered, creators may be required to agree to additional campaign terms and deliverables.

7. Agency & Talent Representation

Certain creators may be invited to work with the TCE agency or talent division.

Agency representation is separate from general TCE membership unless explicitly stated otherwise.

Where TCE formally represents or manages a creator, separate agency or management terms may apply, including commission arrangements, payment terms, responsibilities and the scope of representation.

Being a TCE member does not automatically mean that TCE represents you as your agent or manager.

8. Creator Responsibilities

Members and creators are expected to behave professionally when interacting with TCE, brands, venues, suppliers and other members.

Where you accept an opportunity, you are responsible for completing any agreed deliverables accurately, professionally and within the agreed timeframe.

Failure to fulfil agreed campaign or event obligations may result in removal from that particular opportunity and may affect eligibility for future TCE opportunities.

9. Events, Retreats & Experiences

TCE may organise paid events, networking experiences, creator retreats, trips and other activities.

These may be charged separately from membership.

The price, inclusions, payment schedule, deposit requirements and cancellation terms will be provided before booking.

Unless expressly stated otherwise, travel costs, flights, meals, personal spending and other expenses are not included.

Specific retreats or experiences may have their own booking terms which must be accepted before attendance.

10. Deposits & Payment Plans

Some TCE experiences may allow you to secure your place with a deposit or payment plan.

The applicable payment schedule and cancellation conditions will be displayed or communicated before booking.

Where a payment plan is agreed, you are responsible for ensuring instalments are paid by the relevant deadlines.

Any terms relating to whether deposits or other payments are refundable will be communicated before purchase and will always be subject to your statutory rights.

11. Cancellations & Refunds

Your cancellation and refund rights depend on the service purchased and applicable UK consumer law.

Nothing in these Terms is intended to remove or restrict any statutory cancellation or refund rights that you are legally entitled to.

Where a service, event, retreat or membership has specific cancellation conditions, these will be communicated before purchase and will form part of your agreement with TCE.

Where digital content or services begin during a statutory cancellation period at your express request, this may affect your cancellation rights where permitted by law.

12. Event & Retreat Changes

Occasionally, circumstances outside our reasonable control may require us to change an itinerary, venue, accommodation, supplier, activity or other element of an event or retreat.

Where necessary, we may make reasonable substitutions or amendments while aiming to maintain an equivalent overall experience.

If TCE cancels an event or retreat entirely, your rights and available options will be communicated to you in accordance with the applicable booking terms and consumer law.

TCE is not responsible for separate costs you incur unless we are legally required to reimburse them.

13. Travel Responsibilities

Where attending an international or domestic TCE trip, you are responsible for ensuring that you have appropriate:

  • Passports and travel documentation
  • Visas where required
  • Travel insurance
  • Health or travel requirements
  • Flights and transportation unless expressly included
  • Personal spending funds

We strongly recommend appropriate travel insurance for any retreat or travel experience.

14. Content Creation

TCE events, retreats and experiences may involve photography, videography and social media content creation.

Where applicable, attendees will be informed of relevant content expectations or campaign deliverables.

You remain responsible for ensuring that content you personally publish complies with applicable advertising rules, disclosure requirements, platform policies and any campaign instructions provided to you.

15. Photography & TCE Content

Photography and video may be captured during TCE events and experiences.

Where legally permitted and appropriately communicated, TCE may use event content for purposes such as promoting TCE, its events and its services.

Where additional consent is legally required for a particular use, this will be obtained separately.

16. Intellectual Property

The Creator Estate name, branding, website content, educational materials, documents, graphics, resources and original content belong to TCE or its relevant licensors unless otherwise stated.

Materials provided through a membership, course or service are intended for your personal or professional use only.

You may not reproduce, resell, distribute, publish or commercially exploit TCE materials without prior written permission.

17. Confidentiality

Members may receive access to private opportunities, brand information, rates, contacts, resources or other information that is not publicly available.

Where information is clearly confidential or would reasonably be understood to be confidential, you must not disclose or distribute it without permission.

18. Community Standards

TCE is designed to provide a professional and supportive environment.

We may suspend or terminate access where a member engages in serious or repeated conduct including harassment, discrimination, threatening behaviour, deliberate misuse of confidential information, fraudulent activity or behaviour that materially harms other members, partners or TCE.

Any decision to terminate a paid service will be handled consistently with the member's contractual and statutory rights.

19. Third-Party Services

TCE may work with third-party brands, venues, hotels, photographers, instructors, transport providers, payment processors and other suppliers.

Some services are therefore provided partly or entirely by independent third parties.

Nothing in these Terms excludes or limits TCE's responsibility where doing so would be unlawful.

20. Results & Earnings

TCE does not guarantee:

  • Social media growth
  • Follower increases
  • Brand deals
  • Paid collaborations
  • Business growth
  • Revenue or earnings
  • Media coverage
  • Invitations or PR opportunities
  • Acceptance into the TCE agency

Results vary significantly between individuals and depend on numerous factors, including your own activity, content, audience, experience and external market conditions.

21. Website Use

You must not knowingly misuse our website, attempt to gain unauthorised access to our systems, introduce malicious software or use TCE services for unlawful or fraudulent purposes.

We may restrict access where reasonably necessary to protect TCE, its users or its systems.

22. Privacy

Your personal information will be handled in accordance with our Privacy Policy and applicable UK data protection legislation.

By using our services, you acknowledge that your information will be processed as described in our Privacy Policy.

23. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to applicable law, TCE will not be responsible for losses that were not reasonably foreseeable when the contract was formed or losses arising from circumstances outside our reasonable control.

If you are purchasing our services as a consumer, nothing in these Terms affects your statutory consumer rights.

24. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, legal requirements or business operations.

Where changes materially affect an existing paid membership or contract, we will provide reasonable notice where required.

The latest version of these Terms will be available through our website.

25. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you may also have rights to bring proceedings in the courts applicable to where you live under relevant consumer law.
